DMCA & Intellectual Property Rights Policy

1. Introduction

This DMCA & Intellectual Property Policy (“Policy”) sets out the framework under which NTEC Limited (“We”, “Us”) protects its intellectual property rights, respects the rights of third parties, and handles notices of infringement, takedown requests, counter-notifications, and enforcement actions arising on or in connection with the website, applications, platforms, systems, content, products, and services operated by us (collectively, the “Platform”).

2. Ownership of Intellectual Property

2.1 Scope of Ownership

All intellectual property rights on the Platform, except where explicitly identified as belonging to third parties or users, are owned by or lawfully licensed to NTEC Limited.

This includes, without limitation:

Branding and Identifiers

Trade names, logos, trademarks, service marks, domain names, brand elements, slogans, and all distinctive signs associated with the Platform.

Interface, Layout, and Design

User interface, structure, layout, graphics, visual elements, animations, icons, and overall user experience design.

Textual Content and Materials

Articles, descriptions, guides, legal documentation, promotional content, and all written materials.

Software and Technical Systems

Source code, object code, scripts, APIs, algorithms, system architecture, backend logic, and technical implementations.

Games and Licensed Content

Gaming content, RNG systems, and software provided by third-party suppliers under license. Ownership remains with the respective licensors.

Databases and Data Structures

Structured data, metadata, compiled datasets, system data, and any organized database content.

No ownership rights are transferred to Users under any circumstances.

3. Limited License to Users

Subject to compliance with this Policy and applicable Terms, Users are granted a:

  • revocable
  • non-exclusive
  • non-transferable
  • non-sublicensable

license to access and use the Platform strictly for personal, lawful, and non-commercial purposes.

This license does NOT permit:

  • copying or reproducing content;
  • modifying or creating derivative works;
  • distributing or redistributing content;
  • commercial exploitation;
  • automated data extraction or scraping.

This license shall terminate immediately upon:

  • breach of this Policy;
  • account suspension or termination; or
  • legal or regulatory requirement.

4. Prohibited Conduct

Without prior written authorization, Users shall not:

  • reproduce, distribute, or publicly display Platform content;
  • reverse engineer, decompile, or disassemble software;
  • scrape, crawl, or extract data at scale;
  • replicate Platform structure, design, or database;
  • use trademarks or branding in a misleading manner;
  • upload or distribute infringing content;
  • use Platform content for commercial, SEO, training, or redistribution purposes.

Such actions may constitute:

  • contractual breach;
  • intellectual property infringement;
  • unfair competition;
  • or civil and/or criminal liability.

5. User-Generated Content

5.1 License Grant

By submitting content, you grant NTEC Limited a:

  • worldwide
  • perpetual
  • royalty-free
  • sublicensable

license to use, reproduce, modify, display, and distribute such content for operational, compliance, legal, and service-related purposes.

5.2 User Warranties

You represent and warrant that:

  • you own or have rights to the content;
  • the content does not infringe any rights;
  • the content complies with applicable laws.

You remain fully responsible for your content.

5.3 Indemnification

You agree to indemnify and hold harmless NTEC Limited from:

  • claims;
  • damages;
  • regulatory penalties;
  • legal costs

arising from your content or infringement.

6. Enforcement and Content Control

We reserve the right, at our sole discretion, to:

  • review, restrict, or remove content;
  • suspend or terminate accounts;
  • preserve evidence;
  • take enforcement action without prior notice

where necessary for:

  • legal compliance;
  • regulatory obligations;
  • risk mitigation.

Failure to act in one instance does not waive our enforcement rights.

7. DMCA Takedown Procedure

7.1 Notice Requirements

A valid DMCA Notice must include:

  • authorized signature;
  • identification of the copyrighted work;
  • identification of infringing material (URL);
  • contact details;
  • good faith statement;
  • statement under penalty of perjury.

Incomplete notices may be rejected.

7.2 Actions Upon Receipt

Upon receipt of a valid notice, we may:

  • remove or disable access;
  • notify the user;
  • preserve evidence;
  • apply account restrictions;
  • act immediately where risk is material.

7.4 Misrepresentation

False or abusive notices may result in legal liability, including damages and costs.

8. Counter-Notification Procedure

Users may submit a Counter-Notification including:

  • signature;
  • identification of removed content;
  • good faith statement;
  • consent to jurisdiction;
  • contact details.

We may restore content within 10–14 business days unless legal proceedings are initiated.

Submission constitutes acceptance of legal jurisdiction.

9. Repeat Infringer Policy

We enforce a strict policy against repeat infringers.

Sanctions may include:

  • warnings;
  • permanent account termination;
  • forfeiture of benefits;
  • reporting to authorities.

We are not required to apply progressive enforcement.

10. Fair Use

Certain uses may qualify as fair use.

However:

  • determination is case-specific;
  • burden of proof lies with the User;
  • content may remain restricted pending resolution.

11. Governing Law and Liability

This Policy shall be governed by applicable intellectual property laws and interpreted in conjunction with the Terms of Use.

To the maximum extent permitted by law:

  • we shall not be liable for indirect or consequential damages;
  • we shall not be liable for actions taken in good faith compliance.

Nothing limits our right to seek:

  • injunctive relief;
  • damages;
  • enforcement remedies.

12. Policy Updates

We may update this Policy at any time.

Continued use of the Platform constitutes acceptance of updates.

Material changes may be notified where required.

This Policy shall take effect from the date it is published as the current version on the Platform, unless otherwise stated.
