DMCA & Intellectual Property Rights Policy

This DMCA & Intellectual Property Policy explains how Sunwin protects its own intellectual property rights as well as respects the intellectual property rights of others. We strictly comply with the Digital Millennium Copyright Act (DMCA) and related intellectual property laws. Any infringement of copyright, trademarks, or other intellectual property rights on the platform may result in the removal of the infringing content and actions against the account involved in such infringement.

1. Sunwin's Intellectual Property Rights

All content on the Sunwin website (excluding user-generated content, if any) is owned by us or legally used by us. This content includes (but is not limited to):

  • Trademarks: The name “Sunwin”, logos, slogans, icons, and other service marks. These trademarks are protected under trademark and unfair competition laws. You may not copy or use these trademarks for any commercial purpose without our express written consent. This regulation also applies to domain names, product names, and related applications that may cause confusion with the Sunwin brand.
  • Interface and Design: The entire user interface, website layout, graphic design, icons, and images displayed on the platform. These components are protected by copyright laws and/or other intellectual property regulations. You may not copy or redistribute any part of the website interface for public reuse or commercial purposes.
  • Text Content: Including articles, game descriptions, guides, documents, and any text content drafted on the site by Sunwin or Sunwin's partners. This content is our copyrighted property or we have the legal right to use it. You may read, download, or print content for personal, non-commercial use. However, copying, editing, or republishing all or part of the content for distribution (especially for business purposes) is strictly prohibited without our consent.
  • Games and Software: Casino games, sports betting, RNG software, etc., on Sunwin are provided by various leading game developers. Each game and software is protected by copyright and/or patents of the respective owner. Sunwin is granted the right to distribute and allow you to use the games on our platform. However, this does not mean you own those games. Players are not allowed to reverse engineer, extract source code, create derivative works, or commercially exploit any game/software on Sunwin.
  • Database: Data structures, collections of information about odds, results, player information, etc., compiled by us are also protected. Any large-scale automated data collection (data mining, scraping) without permission violates this policy and may be blocked or penalized.

In summary, any intellectual property rights not explicitly declared as belonging to the user or a third party shall default to Sunwin. We reserve all rights to these intellectual property assets. Your use of our platform does not transfer any intellectual property rights to you, except for the right to use the service within the limits of the specified terms.

2. User-Provided Content

Sunwin may allow users to create or post certain content on the platform (e.g., avatars, comments, reviews, or forum content, if any). For any User-Generated Content (UGC), our policy is as follows:

  • Your Rights: You retain copyright and all intellectual property rights to the content you create and post on Sunwin (unless that content belongs to a third party's intellectual property). However, by posting content on the platform, you agree to grant Sunwin a worldwide, non-exclusive, fully paid, sublicensable, and irrevocable license to use, copy, edit, distribute, display, and perform that content within the scope of our service. (Example: if you post a comment, we have the right to show it to other users, use it in promotional materials about user experience, or edit it (without changing the core meaning) to fit the site content.)
  • Your Responsibility: When posting content, you must ensure that you have the legal right to share that content. This means:
    • The content you create must not copy another person's work without permission. Example: you may not post articles, images, or videos that you did not author or do not own the copyright to, unless that content falls under fair use or the public domain.
    • Content must not violate privacy rights, image rights, or other personal rights of others. Avoid posting others' personal information or using their images without consent.
    • Content must not contain illegal or unethical material, including: hate speech, racism, illegal pornography, defamation, or infringement of others' rights.
    • You must also not post advertising, marketing, or spam content without permission.
  • Control and Removal: Sunwin is not legally responsible for content posted by users; however, we reserve the right to moderate, edit, or remove any UGC on the platform that we deem to violate intellectual property rights, policies, or laws. Moderation may occur before or after content is posted, depending on the case (see Content Moderation Policy for more on our review process).
  • Notification and Reporting: If you discover content posted by another user that shows signs of copyright or policy infringement, please notify us via email: privacy@sun.win. We will review and take appropriate action.

3. DMCA Policy – Copyright Infringement Takedown Notice

We comply with the DMCA notice and takedown process for copyright infringement claims. If you are a copyright owner (or authorized representative) and believe that any content on Sunwin infringes your work's copyright, please send us a written Copyright Infringement Notice. The notice must meet DMCA requirements, including:

  • Physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right allegedly infringed. (Example: you can sign and send a scan or provide a valid electronic signature).
  • Identification of the copyrighted work claimed to have been infringed. Please describe the work or provide a link if the work can be viewed online.
  • Identification of the infringing content on our website that you request to be removed or disabled. Please provide the specific URL or sufficient information for us to locate the content. (Example: link to the page containing the content, or user account name with content description).
  • Your contact information: including full name, address, phone number, and email address so we can contact you.
  • A statement by you that you have a good faith belief that the use of the content in the manner complained of is not authorized by the copyright owner, their agent, or the law (e.g., not fair use).
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Upon receipt of a valid notice, we will:

  • Promptly investigate and remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content (if possible) that their content has been removed pursuant to a DMCA notice.
  • If appropriate, we may terminate the accounts of repeat infringers in accordance with policy and law.

  • Mailing Address: Legal Department - DMCA, Amadeus Technology B.V., Chuchubiweg, Curaçao.

We encourage sending via email for faster processing.

Note: Under the DMCA, any serious misrepresentation, particularly knowingly misrepresenting that content is infringing, may make the complainant liable for damages, including attorney's fees incurred by the affected party. Please only submit a request if you have reliable grounds to believe that the content infringes your copyright.

4. Counter-Notification

If you are a user whose content was removed due to a DMCA notice and you believe your content does not infringe copyright (e.g., you have the right to use it or it does not infringe as alleged), you may send a DMCA Counter-Notification to request content restoration.

The Counter-Notification must be in writing and include:

  • Your physical or electronic signature (account holder/content poster).
  • Identification of the content that has been removed or disabled, and the location where the content appeared before it was removed (e.g., URL).
  • A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  • Your full name, address, phone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of any judicial district where we may be found), and that you will accept service of process from the person who provided the original copyright infringement notification.

Please send the Counter-Notification to our Designated DMCA Agent (use the contact information above; email is preferred). Upon receipt of a valid Counter-Notification, we will:

  • Send a copy of the Counter-Notification to the original copyright complainant, informing them that we may restore the removed content within 10 business days, unless we receive notice from the complainant that they have filed an action in court.
  • If the complainant does not notify us within 10 business days that they have filed a lawsuit seeking a court order against you, we will restore the content (e.g., repost the material) within approximately 10–14 business days of receiving the Counter-Notification.

Note: Sending a DMCA Counter-Notification implies that you agree to resolve the dispute in court (if the complainant decides to sue). If you are unsure about the copyright status of the content, you should consult an attorney before sending a Counter-Notification.

5. Repeat Infringers and Penalties

Sunwin applies a policy of terminating the accounts of users determined to be repeat copyright infringers in appropriate circumstances. “Repeat infringer” is generally understood as a user who has been notified of copyright infringement two or more times. We will track and archive records of DMCA notices as well as corresponding actions.

In addition, infringements of other intellectual property rights (not just copyright) may also lead to penalties:

  • Trademark Infringement: Unauthorized use of Sunwin's trademark or another party's trademark on the platform may result in content removal, warnings, or account suspension, depending on severity.
  • Trade Secret or Software Copyright Infringement: If a user is found deliberately accessing, stealing source code, algorithms, or our technological secrets, we reserve the right to terminate service immediately and may take necessary legal measures.

We reserve the right to take any action we deem appropriate to address intellectual property rights violations, including coordinating with rights holders, reporting to law enforcement, or suing if necessary.

6. Fair Use and Exceptions

Sunwin respects the principle of fair use under copyright law and other legal exceptions. If you believe that the use of content alleged to be infringing actually falls under fair use or is permitted by law (e.g., quoting for commentary purposes, content in the public domain, etc.), please clearly state that in your Counter-Notification as instructed in section 4.

We review each case based on the specific context and applicable laws. Our goal is to protect the legitimate interests of content owners while not unnecessarily affecting users' freedom of speech and creativity.

7. Additional Information

Links and Third-Party Content: The Sunwin platform may contain links to third-party websites or content. We do not control the content of those websites and are not responsible for any intellectual property infringement occurring on third-party websites. Users must comply with the terms of those websites when accessing them.

Third-Party Software: Some games or applications on Sunwin may use third-party software (e.g., plugins, open-source libraries). We comply with relevant licenses (such as GPL, MIT, etc.) and provide copyright/license information in the “About” section or in notes accompanying the game if required. If you believe any third-party software component is not properly credited, please notify us.

Training and Awareness: We train our technical team and administrators on the importance of complying with intellectual property rights, both in product development and content operation. Any employee who seriously violates the intellectual property policy will face internal disciplinary measures.

This DMCA & Intellectual Property Policy aims to establish a clear legal framework to protect the interests of all parties.
